Terms of Service

ShipMyFormis a hosted form backend for websites. You create form endpoints, point your HTML form's action at them, and we receive, store, filter, and route the resulting submissions to the destinations (“connectors”) you configure.

You must provide accurate information and are responsible for all activity under your account. Keep your sign-in method secure and notify us promptly of any unauthorized use. You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the Service.

You agree not to use the Service to:

• collect data unlawfully, or without the notice and consent your form's visitors are entitled to;
• send spam, phishing, malware, or otherwise unlawful, deceptive, or harmful content;
• violate the rights of others, including privacy and intellectual property rights;
• probe, overload, disrupt, or circumvent the security or rate limits of the Service; or
• resell or provide the Service to third parties without our consent.

We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for us.

As between you and ShipMyForm, you own the form submissions and content you collect through the Service (“Your Data”). You grant us the limited rights needed to host, process, and route Your Data to deliver the Service.

You are the controller of Your Data and are responsible for having a lawful basis to collect it, for providing your visitors with any required privacy notices, and for honoring their rights. You must not collect special-category or highly sensitive data (for example, government IDs, health, or payment card numbers) through the Service.

Our handling of personal data is described in our Privacy Policy, which is incorporated into these Terms by reference. Please review it to understand what we collect and how we use it.

We offer a free plan subject to the limits published on our pricing page (including a monthly submission allowance). Paid plans, when offered, are billed in advance on a recurring basis through our payment processor. Fees are non-refundable except where required by law. We may change plan features and prices prospectively with reasonable notice.

The Service can deliver submissions to third-party tools (such as Slack, Google Sheets, Notion, Zapier, or your own webhook). Your use of those tools is governed by their terms, and we are not responsible for third-party services or their availability.

The Service, including its software, design, and brand, is owned by ShipMyForm and protected by intellectual-property laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service; no other rights are granted.

We work to keep the Service reliable but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. Planned and unplanned downtime may occur.

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, ShipMyForm will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim or USD 50.

You agree to indemnify and hold ShipMyForm harmless from claims, losses, and expenses arising out of Your Data, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you breach these Terms or to protect the Service. On termination, your right to use the Service ends; we may delete Your Data after a reasonable period consistent with your plan's retention.

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by email or an in-product notice). Your continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws applicable at ShipMyForm's principal place of business, without regard to conflict-of-laws rules. The courts located there will have exclusive jurisdiction, except where applicable law grants you the right to bring proceedings in your local courts.
